Manufactured Product Warranty
1. General Warranty: Seller warrants to the Buyer that goods manufactured by Seller shall be free under normal use from defects in workmanship for one (1) year (12 months of 1 shift) from Seller’s date of shipment. Seller incorporates purchased products in its goods and does not warrant those purchased products as to their material or workmanship.
2. Storch Spec Warranty for Series 500, 800, 1100: Storch Magnetic Slide Conveyors built to "Storch Spec" carry a three (3) year warranty. "Storch Spec" indicates that the Buyer has adopted all the Seller’s recommendations for the design and manufacture of the product, and that the product is exclusively used for the original application for which it was designed. Additionally, products built to "Storch Spec" have a craftsmanship warranty of five (5) years. Wear items such as chain, slider bed, track, sprockets, magnets, and drives are not warranted under craftsmanship.
3. Storch Spec Warranty for Series 200, 300: Storch Magnetic Slide Conveyors built to "Storch Spec" carry a one (1) year warranty. "Storch Spec" indicates that the Buyer has adopted all the Seller’s recommendations for the design and manufacture of the product, and that the product is exclusively used for the original application for which it was designed. Additionally, products built to "Storch Spec" have a craftsmanship warranty of five (5) years. Wear items such as chain, slider bed, track, sprockets, magnets, and drives are not warranted under craftsmanship.
4. Warranty Coverage and Claims: Seller's obligation under this warranty is limited to repair or replacement, at Seller's sole discretion, of those goods sold by Seller to Buyer which have become defective because of ordinary and normal use in accordance with the designed purpose and intended application of the goods. The determination of whether a defect exists shall be made solely by Seller. Buyer shall not return any goods to Seller until Seller has been provided with a reasonable opportunity to inspect and sample the goods at the Buyer’s premises to determine whether a defect exists and whether the goods should be repaired or replaced. Buyer shall also provide Seller with an opportunity to participate in any root cause analysis performed by Buyer.
5. Shipping Responsibility: The Buyer is responsible for all shipping charges incurred to return goods to Seller for inspection, repair, or replacement, as well as the shipping charges to return the goods back to the Buyer's location after service.
6. Warranty Limitations: This warranty does not cover any damage to a person or property arising from the use of any goods furnished by Seller, nor does it cover any costs associated with the removal, transportation, and/or reinstallation of the goods. This warranty is contingent on full payment for the goods. The warranty is not transferable and applies only to the original Buyer for the original application for which the product was designed.
7. Disclaimer: NOTWITHSTANDING ANY OTHER PROVISION HEREIN, SELLER EXPRESSLY DISCLAIMS AND EXCLUDES ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, AND ALSO DISCLAIMS AND EXCLUDES ALL LIABILITY FOR INCIDENTAL AND CONSEQUENTIAL DAMAGES FOR BREACH OF WARRANTY OR OF CONTRACT OR OTHERWISE. THE WARRANTY PROVIDED IN THIS PARAGRAPH IS THE SOLE AND EXCLUSIVE REMEDY OF BUYER AGAINST SELLER. SELLER IS NOT RESPONSIBLE FOR ERRORS IN BUYER SUPPLIED GEOMETRY.
EXCEPT AS OTHERWISE EXPRESSLY AUTHORIZED IN A WRITING SIGNED BY AN AUTHORIZED AGENT OF STORCH, ALL INDIRECT, SPECIAL, CONSEQUENTIAL (INCLUDING LOST PROFITS OR MARKET SHARE OR DAMAGE TO BRAND VALUE), INCIDENTAL, PUNITIVE, AND EXEMPLARY DAMAGES, WHETHER OR NOT FORESEEABLE, ARE EXCLUDED UNDER THESE TERMS AND CONDITIONS TO THE EXTENT PERMITTED BY APPLICABLE LAW.
8. Claims Procedure: Any claim for breach of Seller's warranty must be made in writing to the Seller, setting forth sufficient detail to permit identification of the defect. Any claim for breach of warranty must be made within twelve (12) months after receipt of shipment. If not made within the twelve (12) month period, it shall be conclusively deemed to have been waived.
Return Policy
Merchandise cannot be returned without authorization. All requests for refunds or exchanges must be made within fifteen (15) days after invoice.
Items returned for reasons other than the above-referenced warranty claims are subject to a minimum returned goods charge of $50.00 or a 10% re-stocking fee, whichever is greater.
MAGNETS: Special magnets or materials that Storch has altered to Buyer’s specifications, or that have been altered by Buyer after receipt of goods, are not returnable.
MANUFACTURED PRODUCTS: Deposits for manufactured products are not refundable if the order is canceled prior to build. Manufactured product orders that have been built are not cancelable, returnable or subject to any refunds; payment in full is due regardless of refusal of acceptance of delivery.
